1. Introduction and Agreement Acceptance

Welcome to LaunchLens. These Terms of Service ("Terms") govern your use of the LaunchLens platform, including our website, mobile applications, and all related services (collectively, the "Service"). LaunchLens is operated by LaunchLens, Inc. ("we," "us," or "our").

By accessing or using LaunchLens, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service. We may update these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Service Overview

LaunchLens is a YouTube optimization platform that helps content creators enhance their video performance through:

• AI-powered generation of optimized titles, descriptions, and tags
• Performance analytics and improvement suggestions
• YouTube channel integration via secure OAuth authentication
• Content analysis and metadata optimization

Our Service analyzes your video content to provide contextual, niche-specific recommendations designed to improve discoverability and engagement.

3. Eligibility

You must be at least 13 years old to use LaunchLens. By using our Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you must have parental or guardian consent to use the Service.

You must also have a valid YouTube account and comply with YouTube's Terms of Service to use our optimization features.

4. User Obligations

As a user of LaunchLens, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account
• Use the Service in compliance with all applicable laws
• Respect intellectual property rights of others
• Follow YouTube's Community Guidelines and Terms of Service
• Not impersonate others or provide false information

5. Prohibited Uses

You may not use LaunchLens to:

• Violate any laws, regulations, or third-party rights
• Upload, process, or optimize content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Engage in any form of automated scraping, data mining, or harvesting
• Attempt to gain unauthorized access to our systems or user accounts
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to send spam or unsolicited communications
• Create multiple accounts to abuse free trial offerings
• Resell or redistribute our Service without authorization
• Generate misleading or deceptive content

6. Account Termination and Suspension

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. You may also terminate your account at any time by contacting support@launchlens.tech.

Upon termination, your right to use the Service will immediately cease. We may retain certain information as required by law or for legitimate business purposes.

8. Billing, Cancellation and Refunds

How billing works. Paid plans are subscriptions handled by Stripe. A monthly plan bills every month and a yearly plan bills every twelve months, automatically, on the date you subscribed, until you cancel. The price you see at checkout is the price you pay, and we will always tell you before it changes.

Cancelling. You can cancel at any time from your billing settings. Cancelling stops the next charge. It does not end your current period: you keep your plan and the credits already in your account until the period you have paid for runs out.

Refunds. We do not automatically refund part-used periods, and credits you have already spent on a render cannot be refunded, because the cost of producing it has already been incurred. That said, if something went wrong on our side, a render failed and your credits were not returned, you were charged twice, or the product did not do what this page says it does, email support@launchlens.tech and we will make it right. We would rather refund someone than argue with them.

Credits. Plan credits are an allowance and reset at the start of each billing period. Credits you buy separately in a pack do not expire and stay in your account, including if you cancel your plan.

9. Intellectual Property

LaunchLens and its original content, features, and functionality are owned by LaunchLens, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your content and our license. You own every image you create with LaunchLens. By using the Service, you grant LaunchLens a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and create derivative works from the content you create, for the purposes of operating, securing, and improving the Service. This license exists so we can store your work, show it back to you, and make the product better; it does not give us the right to sell your images or pass them off as our own.

The template pool (opt-in only). If you choose to add a creation to the LaunchLens template pool, you additionally grant us the right to transform it into a reusable template and distribute that template to other LaunchLens users. Templates are always transformed derivatives: your face, your channel name, and your identifying details are removed before anything is shown to another user. Adding to the pool is always your explicit choice, made per image, and may earn a credit reward as described in our Privacy Policy.

The AI-generated suggestions provided by LaunchLens are for your use in connection with your YouTube content. You are responsible for ensuring that your use of these suggestions complies with all applicable laws and third-party rights.

10. No Guarantees / Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be error-free, uninterrupted, secure, or free from viruses. We do not warrant that any optimization suggestions will result in increased views, engagement, or revenue. Your use of the Service is at your sole risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUNCHLENS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO LAUNCHLENS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless LaunchLens, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Delaware for the resolution of any disputes.

14. Updates to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

15. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and LaunchLens regarding the use of the Service.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision.
